Flood level advice

Hi guys,

I am after some advice on an issue I have just come across on my first and current project. I recently purchased a block of land in the Hunter region of which i'm wanting to place a duplex on the block. I was aware prior to the purchase that the land was in a low level flood risk with a 1/100 year level of 350mm. I had no concerns with this and all was sweet as this was factored into the design of the house. The DA is in process through council and they have come back with a ridiculous 1.2M height restriction within this low level flood space. This now changes the whole course of the project and will ultimately for a number of reasons make the project unprofitable. Can anyone offer any advice on the course of action I could take with council as this height requirement is just not an option. The front block of units on the same land has a 350mm restriction which makes more sense. Has anyone had a similar situation and have successfully negotiated this down with council?

It's almost impossible to negiotiate with councils -- I would try to find the relevant policy and attempt to find a clause etc that means you don't have to comply with their request...

Is the restriction only for duplexes? Does the same apply for houses/units etc?

Has it something to do with the % of the land used for the building footprint?
